01 Acceptance of Terms
By accessing or using any service provided by testers.ai or icebergqa.com (collectively, "the Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Services.
These Terms apply to all users, including visitors, registered accounts, API consumers, and customers of managed testing engagements. "You" means the individual or entity accessing the Services.
The Services are operated by Testers.ai, Inc. ("we," "us," "our"), a company incorporated in the United States.
02 Description of Services
We provide AI-powered software quality and testing services, including but not limited to:
- testers.ai — An AI chat assistant and platform for software quality intelligence, agent-based testing analysis, and test generation.
- testers.ai Cloud — Automated AI testing runs that crawl web applications, surface bugs and quality issues, and generate structured reports across multiple quality dimensions.
- icebergqa.com — Expert-managed AI testing engagements supervised by human quality engineers.
- Claude MCP Plugin — An integration for Anthropic's Claude AI environment enabling programmatic test submission and report retrieval.
- API & SDK — Programmatic access to our testing infrastructure for CI/CD integration and custom workflows.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice where practicable.
03 AI Testing — Scope & Limitations
Our Services use large language models (LLMs), autonomous agents, and automated browsers to analyze web applications. You acknowledge that:
- AI testing is probabilistic. Results may vary between runs. Issues may be missed and false positives may be reported.
- We do not guarantee that our testing will identify all bugs, security vulnerabilities, accessibility failures, or other defects in your application.
- Our Services supplement — they do not replace — professional security audits, compliance certifications (e.g. SOC 2, ISO 27001, HIPAA), penetration testing, or human quality assurance processes for safety-critical systems.
- Fix prompts and remediation suggestions are provided as AI-generated guidance only. You are responsible for validating and implementing any changes to your codebase.
- Test runs access only publicly reachable pages or pages you have explicitly authorized us to access via tunnels or credentials you provide.
04 Accounts & Access
Some features require creating an account. You agree to provide accurate, current information and to keep your credentials secure. You are responsible for all activity under your account.
We may offer free-tier access with rate limits, demo runs, or trial periods. Free-tier results may be retained for quality improvement purposes (see Section 8). Paid plans govern data retention and privacy more strictly.
You must be at least 16 years old to use the Services. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.
05 Acceptable Use
You agree not to use the Services to:
- Test applications, systems, or URLs you do not own or have explicit written authorization to test.
- Conduct denial-of-service attacks, credential stuffing, or any activity that disrupts third-party systems.
- Attempt to reverse-engineer, extract, or reproduce our AI models, prompts, or proprietary testing logic.
- Circumvent rate limits, abuse demo quotas, or create multiple accounts to evade restrictions.
- Submit harmful, illegal, or privacy-violating content through the chat interface or API.
- Use the Services in connection with illegal activity or to harm any person or entity.
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, at our sole discretion.
06 Fees & Payment
Certain Services are offered free of charge subject to usage limits. Paid plans, managed engagements, and API access are subject to the pricing in effect at the time of purchase, as displayed on our pricing pages or agreed in a separate order form.
- Billing. Subscription fees are billed in advance on a monthly or annual basis. Usage-based charges are billed in arrears.
- Refunds. Subscription fees are non-refundable except where required by applicable law or as stated in a separate agreement.
- Taxes. Prices exclude applicable sales tax, VAT, or similar charges, which are your responsibility.
- Changes. We may change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance.
07 Intellectual Property
Our IP. The Services, including our AI models, testing agents, report formats, user interface, branding, and underlying technology, are owned by Testers.ai, Inc. and protected by intellectual property law. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding.
Your IP. You retain all rights to your applications, source code, data, and content submitted for testing. By submitting a URL or application, you grant us a limited, non-exclusive license to access and process it solely to provide the Services.
Reports. AI-generated reports produced by our Services are owned by you, subject to any restrictions in your plan tier. We may use anonymized, aggregated quality metrics (with no personally identifiable information) to improve our Services and publish benchmark data.
08 Data & Privacy
Our collection and use of personal data is governed by our Privacy Policy, incorporated herein by reference.
- Test data. URLs and pages submitted for testing are processed transiently. We do not store raw page content beyond what is necessary to generate and display your report.
- Report data. Generated reports are stored on our servers. Free-tier reports may be retained for up to 90 days. Paid-plan reports follow the retention policy in your plan.
- Email. Email addresses provided for demo runs are used only to deliver your report and to send relevant product communications. You may opt out at any time.
- LLM providers. When you configure our Services to use a third-party LLM (Claude, GPT-4, Gemini, etc.), your data may be processed by that provider subject to their terms.
- Self-hosted. If you run a self-hosted deployment, your data does not leave your infrastructure.
09 Disclaimers
We disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated results. We do not warrant that the Services will be uninterrupted, error-free, or free from security vulnerabilities.
AI test results are not legal, security, or compliance certifications. Do not rely solely on our outputs for regulatory compliance, safety-critical decisions, or financial determinations.
10 Limitation of Liability
To the maximum extent permitted by applicable law, Testers.ai, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising from these Terms or the Services shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
11 Indemnification
You agree to indemnify, defend, and hold harmless Testers.ai, Inc. and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services in violation of these Terms; (b) your applications or content submitted for testing; (c) your violation of any third-party rights; or (d) your violation of applicable law.
12 Term & Termination
These Terms are effective from the date you first access the Services. Either party may terminate at any time. You may stop using the Services and delete your account at any time. We may suspend or terminate your access for violations of these Terms, non-payment, or at our discretion with reasonable notice.
Upon termination: your right to use the Services ceases immediately; we may delete your data in accordance with our retention policies; Sections 7, 9, 10, 11, and 14 survive termination.
13 Changes to Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify registered users by email or in-product notice. Your continued use of the Services after the effective date of updated Terms constitutes acceptance.
If you disagree with revised Terms, your sole remedy is to stop using the Services and close your account.
14 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
If you are located in the European Union, you may also have rights under the laws of your member state. Nothing in these Terms limits rights you cannot waive under applicable consumer protection law.
